Question:

Management of Drug and Alcohol Testing: Does an employer have to join a consortium in order to have its drivers random drug tested or can the drug and alcohol program be managed by the employer?

Answer:

If an employer has more than one employee who is subject to DOT drug and alcohol testing, the employer may manage its DOT drug and alcohol testing program.  Employers with only one employee subject to DOT testing (e.g., owner-operators) who is not leased to another motor carrier, are required to belong to a consortium for random testing purposes. [See §382.305, Question 11]
