FMCSA Petitions for Rulemaking (Closed Petitions)

Closed petitions are petitions for rulemaking that have been granted or denied by the Administrator. In accordance with 49 CFR 389.33(b), the granting of the petition and the commencement of a rulemaking proceeding does not signify, however, that the proposed regulatory changes will ultimately be adopted. A decision as to the issuance of a final rule is made on the basis of all available information developed in the course of the rulemaking proceeding, including comments received in the rulemaking docket, in accordance with statutory criteria.

Petitions For Reconsideration

Any interested person may petition the Administrator for reconsideration of any rule issued under part 49 CFR 389. The petition for reconsideration must be in English and submitted to the Administrator, Federal Motor Carrier Safety Administration, 1200 New Jersey Ave. SE, Washington, DC 20590–0001, or electronically submitted using the docket for the rulemaking at www.regulations.gov and received not later than thirty (30) days after publication of the rule in the Federal Register.
