In accordance with 49 CFR 389.33(b), the granting of the petition and the commencement of a rulemaking proceeding does not signify, however, that the proposed regulatory changes will ultimately be adopted. A decision as to the issuance of a final rule is made on the basis of all available information developed in the course of the rulemaking proceeding, including comments received in the rulemaking docket, in accordance with statutory criteria.
