PLEASE READ THESE TERMS OF USE (“TERMS”) CAREFULLY BEFORE DOWNLOADING OR USING THE IDEMIA IDENTITY PROOFING APPLICATION. BY PROCEEDING WITH THE REGISTRATION, YOU AGREE TO BE BOUND BY THESE TERMS.

  1. Acceptance of Terms

By using the FMCSA Unified Registration System (URS) or the FMCSA Portal Account (collectively, "FMCSA Systems"), you acknowledge and agree to these Terms and certify that you have read and understood them. The URS serves as FMCSA's online registration system for entities regulated by the Agency, while the FMCSA Portal provides single sign-on access to FMCSA systems, allowing users to access the Agency's information systems with a single set of credentials. Users accessing the URS or the FMCSA Portal for the first time are required to complete identity verification. Identity verification, also known as identity proofing, is a process used to verify and authenticate the identity of a person attempting to access a service or system. This process confirms that an identity exists in the real world and ensures that the individual presenting that identity is its true owner. Identity verification is essential for maintaining the security and integrity of FMCSA systems. FMCSA Systems utilize Login.gov services to authenticate user access and to track the completion of identity verification through the email associated with the user's Login.gov credentials.

  1. Identity Verification Process

You will be redirected to a third-party vendor's website (IDEMIA) to complete the identity verification process if you have not done so previously. FMCSA does not store any personal information provided during the identity verification process. You are required to review and accept these Terms before being redirected to IDEMIA's website. By proceeding with this process, you acknowledge that you have reviewed and agree to comply with IDEMIA's Digital Identity Proofing Application Terms of Use and any applicable terms and conditions, which are required for utilizing the identity verification services. IDEMIA will collect and process personal information and biometric data to verify your identity. You must successfully complete the identity verification process before you can complete your application for registration in URS or register for an account in the FMCSA Portal. If you have previously completed the identity verification process in FMCSA Systems, you will not be required to do so again. Upon successful completion of the identity verification process, you will be redirected back to the FMCSA System to finalize your registration.   1. Data Collection and Privacy

The FMCSA does not receive any personal information provided to IDEMIA, except to confirm that the identity verification process has been completed. IDEMIA will manage your data in accordance with its privacy policy, which includes the collection, processing, and storage of personal and biometric data necessary for identity verification. This means that all personal information collected during the identity verification process is handled by IDEMIA and not stored or managed by FMCSA.   1. Use of the FMCSA Systems

The URS and FMCSA Portal are U.S. Government information systems. These systems, including all related equipment, networks, and network devices, are provided solely for authorized U.S. Government use. Unauthorized or improper use of these systems is prohibited and may result in civil and criminal penalties or administrative disciplinary action. Communications and data stored on or transiting through these systems may be monitored, recorded, and are subject to audit or investigation for any lawful government purpose. By using these systems, you consent to such monitoring and recording. You agree to use the FMCSA Systems only for lawful purposes and in a manner that does not infringe upon the rights of, or interfere with, the use of the systems by any third party. Prohibited activities include, but are not limited to, hacking, introducing viruses or other malicious code, and engaging in any behavior that disrupts or diminishes the quality of the services provided by FMCSA.

  1. Limitation of Liability

FMCSA and its affiliates, officers, agents, and employees shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses arising from or related to the use or inability to use FMCSA Systems due to the failure to successfully complete the identity verification process. Such limitations of liability extend to any disruptions, delays, or issues encountered during the identity verification process, regardless of whether these issues are caused by technical errors, user error, or any other factor beyond the control of FMCSA.

  1. Modifications to Terms

FMCSA reserves the right to modify these Terms at any time. Such modifications may include, but are not limited to, changes in the procedures for identity verification, data collection and privacy practices, or usage guidelines for the FMCSA Systems. You will be notified of any significant changes to these Terms. Your continued use of the FMCSA Systems following the implementation of any modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically to stay informed of any updates or changes.
