EXECUTIVE ORDER No. 17-05

EMERGENCY RELIEF FOR DAMAGE CAUSED BY DROUGHT IN NORTH DAKOTA & SOUTH DAKOTA

WHEREAS, The Governors of North Dakota and South Dakota have issued disaster declarations in their states due to recent and ongoing drought conditions; and

WHEREAS, the Governors of North Dakota and South Dakota have issued Executive Orders declaring a State of Emergency in their respective states; and

WHEREAS, agricultural producers are requesting donations of hay which will require the operation of motor carriers and drivers of commercial motor vehicles for the purpose of providing direct assistance to impacted areas in the State of North Dakota and the State of South Dakota;

NOW THEREFORE, pursuant to the authority vested in me as Governor by the Constitution and the emergency management laws of the State of Nebraska, I hereby direct and order as follows:

  1. This order applies to motor carriers directly participating in drought relief efforts in North Dakota and South Dakota; and
  2. In conjunction with the waivers issued by the Governors of North Dakota and South Dakota, the requirements contained in the federal Motor Carrier Safety Regulations (49 CFR Parts 390-399) are hereby suspended through the duration of the motor carrier's assistance in the disaster relief effort, effective July 12, 2017 and to remain in effect until August 9th; and
  3. The length and weight hauling requirements of federal and state law are also hereby suspended through the duration of the motor carrier's assistance in the disaster relief
  4. effort; and
  5. The requirements for trip permits pertaining to vehicle registrations, set forth in Neb. Rev. Stat. §60-3,198 and for fuel tax permit requirements, set forth in Neb. Rev. Stat. §66-1,114 are hereby suspended through the duration of the motor carrier's assistance in the disaster relief effort; and
  6. All other applicable state and federal laws and regu lations shall apply to motor carriers and vehicles assisting in the disaster relief effort.
