EMERGENCY MANAGEMENT-FREEZING TEMPERATURES, HARM TO AGRICULTURE
EMERGENCY ORDER
(Pursuant to Executive Order No. 22-27)

I, Kevin J. Thibault, P.E., Secretary of the Florida Department of Transportation (“Department”), hereby find that pursuant to Executive Order 22-27, the Department’s response to the emergency is hindered by statute, rule or order and that it is necessary to suspend or waive certain statutes to protect Florida’s agricultural assets and the general welfare of the State as a result of freezing temperatures experienced by portions of the State.

Therefore, pursuant to the authority granted by Executive Order 22-27, I hereby waive and suspend the following statutes: sections 316.515(1)-(3), 316.545(2) and 316.550(1), Florida Statutes to the extent necessary to allow the establishment of alternate size and weight restrictions for divisible loads for any vehicles transporting emergency equipment, services, supplies, and agricultural food commodities and citrus as recommended by the Commissioner of Agriculture, and authorize the Department to waive permits and/or issue temporary permits, subject to the limitations contained in Executive Order 22-27.

This order shall expire on the earlier of the expiration or rescission of Executive Order 22-27, my further order or March 7, 2022.
