CONTINUATION OF EMERGENCY RELIEF FOR DAMAGE CAUSED
BY DROUGHT IN NORTH DAKOTA, SOUTH DAKOTA, & MONTANA
WHEREAS, on July 13, 2017, 1 issued Executive Order 17-05 which waived requirements contained in the Federal Motor Carrier Safety Regulations (49 CFR Parts 390399) and suspended select other requirements of federal and state law for motor carriers' assistance in the disaster relief effort; and
WHEREAS, North Dakota and South Dakota remain during extreme drought conditions and Montana has now declared a drought emergency; and
WHEREAS, the Field Administrator for the Federal Motor Carrier Safety Administration (FMCSA) issued a Regional Emergency Declaration in the States of South Dakota, North Dakota, and Montana on July 31, 2017;
NOW THEREFORE, pursuant to the authority vested in me as Governor by the Constitution and the emergency management laws of the State of Nebraska, I hereby direct and order as follows:
- Effective immediately, in conjunction with the FMCSA Regional Emergency Declaration granting emergency relief from Parts 390 through 399 of Title 49 Code of Federal Regulations, waive the requirements contained in the federal Motor Carrier Safety Regulations consistent with the terms and conditions of the Regional Emergency Declaration until 11 p.m. on Friday, September 1, 2017.
- Effective immediately, the specific terms and conditions of Executive Order 17-05, related to length and weight hauling requirements and trip permits pertaining to vehicle registrations which are set to expire effective August 9, 2017, shall be extended and continued until 11:59 p.m. on Friday, September 1, 2017; and
- This Executive Order 17-06, shall be effective 12:00 a.m. on Thursday, August 3, 2017, and shall expire, along with Executive Order 17-05, at 11:59 p.m. on Friday, September 1, 2017.
