NOTICE OF WAIVER OF CERTAIN FEDERAL MOTOR CARRIER SAFETY REGULATIONS

 

On March 10, 2020, the Honorable Ned Lamont, Governor of the State of Connecticut, issued a Declaration of Civil Preparedness and Public Health Emergencies for the State of Connecticut, in response to the pandemic COVID19. Under 49 CFR § 390.23 of the Federal Motor Carrier Safety Regulations (regulations), the Governor's Declaration activates a waiver of the requirements in 49 CFR Parts 390 through 399 when providing emergency relief in response to the emergency. "Emergency relief means an operation in which a motor carrier or driver of a commercial motor vehicle is providing direct assistance to supplement State and local efforts and capabilities to save lives or property or to protect public health and safety as a result of an emergency as defined in this section." The definition of "emergency" in §390.5t of the regulations includes an "... occurrence, natural or man-made, which interrupts the delivery of essential services (such as, electricity, medical care, sewer, water, telecommunications, and telecommunication transmissions) or essential supplies (such as, food and fuel) or otherwise immediately threatens human life or public welfare... "

 

The waiver provided under the regulations does not apply to any motor carrier that is under an out-of-service order or that is subject to suspension or revocation of its operating authority or registration privileges under any provision of state or federal law.
