Concerning exemptions regarding Hours of Service for heating fuel transporters:
In conjunction with surrounding states, the Colorado State Patrol is approving a temporary exemption from 8CCR 1507-1 MCS 6, Part 395.3, Hours of Service for transport haulers of consumer heating fuels, propane, and natural gas.
The Colorado State Patrol recognizes the importance of timely and consistent consumer heating fuel deliveries in Colorado for Public Safety Functions as well as consumer needs.
Pursuant to 8CCR 1507-1 MCS 2.2, the Colorado State Patrol approves the exemption under the guidelines below:
- The exemption shall be granted only through January 31st, 2023.
- The exemption shall only apply to commercial transporters who are hauling heating fuels, propane, and natural gas.
All other applicable state and federal regulations shall apply to include but not limited to: Title 49 C.F.R. Part 382, Controlled Substances and Alcohol Use and Testing; Part 392.3 (ill and fatigued drivers) carriers will be responsible for monitoring its drivers for fatigue.
Should it become apparent that a driver’s ability or alertness is impaired or is likely to become impaired by fatigue or illness; the driver must not be allowed to drive. In addition, an ill or fatigued driver shall not operate a commercial motor vehicle.
