SUBJECT: Suspension of Application of 49 C.F.R. Part 395 for Delivery Drivers of Residential Heating Fuel
As DPS Commissioner, I am in receipt of your request regarding the severe weather event beginning January 14, 2024. Specifically, you advise:

[The Liquefied Petroleum Gas Administration has] received numerous calls from our Class 2 transporters (long haulers) and Class 1 Dealers (who deliver propane to residential and commercial) who have many drivers that are already at their driving hour limit and have had to pause residential deliveries until their hours reset.

Based on the feedback we have received so far; we feel the “suspension of hours- of-service” should be enacted for a minimum of 3 to 5 days.
Pursuant to the delegation of authority by Governor J. Kevin Stitt in accordance with 49 C.F.R. § 390.23, I hereby suspend application of 49 C.F.R. Part 395 for delivery drivers of residential heating fuel due to the severe weather beginning January 14, 2024. The suspension of 49 C.F.R Part 395 shall commence 12:00 a.m. CST on Friday, January 12, 2024, and cease 11:59 p.m. CST on Tuesday, January 16, 2024. This suspension of application of 49 C.F.R Part 395 applies for all counties in Oklahoma.
This limited suspension of 49 C.F.R. Part 395 shall not be construed as the declaration of a natural or man-made emergency under the provisions of the Oklahoma Emergency Management Act of 2003 or any other Oklahoma law. Nor shall the limited suspension of 49 C.F.R. Part 395 be construed as an exemption from the enforcement of any other laws, regulations, or rules pertaining to the operation of commercial motor vehicles.
