The U.S. Department of Transportation's New Hampshire Division Office of the Federal Motor Carriers Safety Administration (FMCSA) today announced enforcement actions against motor carriers since January 2004 for violations of the Federal Motor Carrier Safety Regulations (FMCSR) and/or Hazardous Materials Regulations (HMR).

"We are serious about reducing large truck and bus crashes that result in death and injury on U.S. roadways," said Bruce D. Holmes, FMCSA New Hampshire division administrator. "Carriers need to know that by refusing to operate safely they will suffer consequences of the law in order to prevent other motorists from paying a stiffer price."

In March 2004, Monadnock Mountain Spring Water, Inc. was fined $14,340 for violating hours-of-service regulations. Nicary Trucking, Inc. was fined $8,370 for operating a commercial motor vehicle (CMV) without the proper insurance or required registration, and failing to keep driver's hours-of-service (HOS) records and inspection and vehicle maintenance records.

In February 2004, Gary's Fuel Service, Inc. was fined $8,100 for failing to retain required cargo tank manufacturer's reports and failing to keep driver's HOS records and inspection and vehicle maintenance records.

In January 2004, Red's of Jaffery LLC was fined $10,970 for transporting hazardous materials (HM) without a security plan and failing to instruct employees about HM regulations. Windward Petroleum, dba Bailey Distributing was assessed a civil penalty of $23,010 for failing to instruct employees about HM regulations, transporting a shipment of HM without proper shipping papers, failing to conduct required random controlled substances testing of its drivers and failing to require drivers to keep HOS records.
