EXECUTIVE ORDER No. 17-09
EMERGENCY RELIEF FOR IMPACTS BY HURRICANE HARVEY & IRMA

WHEREAS, the Governors of Texas, Louisiana & Florida have issued emergency orders in their states due to the impact of Hurricane Harvey & Irma; and

WHEREAS, the Governors of Texas, Louisiana & Florida are requesting assistance in transporting supplies, equipment and persons into and from the States of Texas, Louisiana & Florida and which will require the operation of motor carriers and drivers of commercial motor vehicles for providing direct assistance to impacted areas in the States of Texas, Louisiana, Florida and any other states directly impacted by Hurricane Harvey and/or Irma;

NOW THEREFORE, pursuant to the authority vested in me as Governor by the Constitution and the emergency management laws of the State of Nebraska, I hereby direct and order as follows:

1.This order applies to motor carriers directly participating in hurricane relief efforts;

2.In conjunction with the FMCSA Regional Emergency Declaration granting emergency relief from Parts 390 through 399 of Title 49 Code of Federal Regulations, waive the requirements contained in State Statutes 75-363 consistent with the terms and conditions of the Regional Emergency Declaration;

3.The length and weight hauling requirements of federal and state law are also hereby suspended through the duration of the motor carrier's assistance in the disaster relief effort;

4.The requirements for trip permits pertaining to vehicle registrations, set forth in Neb. Rev. Stat. 560-3,198 and for fuel tax permit requirements, set forth in Neb. Rev. Stat. 5661,114 are hereby suspended through the duration of the motor carrier's assistance in the disaster relief effort;

5.All other applicable state and federal laws and regulations shall apply to motor carriers and vehicles assisting in the disaster relief effort; and

6.This Executive Order shall remain in effect until 11:59 p.m. on September 30, 2017.

Pursuant to this declaration, I hereby order the following:

1.No motor carrier operating under the terms of this emergency declaration shall require or allow an ill or fatigued driver to operate a motor vehicle. A driver who notifies a motor carrier that he or she needs immediate rest shall be given a least ten (10) consecutive hour's off-duty before the driver is required to return to service.

2.Drivers operating under this proclamation shall carry a copy of the proclamation with them as evidence of their direct support to the State of Nebraska during this emergency period.

IN WITNESS, THEREOF, I have hereunto set my hand and caused the Great Seal of the State of Nebraska to be effected on this 8th day of September, 2017.
