REGIONAL EMERGENCY DECLARATION UNDER 49 CFR § 390.23 No. 2018-0001
ALABAMA, FLORIDA, LOUISIANA, MISSISSIPPI

In accordance with the provisions of 49 CFR § 390.23, the Regional Field Administrator for the Federal Motor Carrier Safety Administration's (FMCSA) Southern Service Center, hereby declares that an emergency exists that warrants issuance of a Regional Emergency Declaration and an exemption from Parts 390 through 399 of the Federal Motor Carrier Safety Regulations (FMCSRs), except as otherwise restricted by this Emergency Declaration. Such emergency is in response to Tropical Storm/Hurricane Nate and its anticipated effects on people and property in the Affected States and jurisdictions, including the immediate threat to human life or public welfare. Affected States and jurisdictions included in this Emergency Declaration are: Alabama, Florida, Louisiana and Mississippi

NOTICE OF ENFORCEMENT DISCRETION DETERMINATION

ALABAMA, FLORIDA, LOUISIANA, MISSISSIPPI

This is a Notice that the Federal Motor Carrier Safety Administration (FMCSA) has exercised agency discretion and determined not to enforce the Temporary Operating Authority Registration fee provisions of 49 C.F.R. 360.3T(d)(2) and (f)(6) against those Motor carriers requesting Temporary Operating Authority Registration to provide direct assistance to emergency relief efforts pursuant to the Regional Emergency Declaration No. 2018-0001, dated October 6, 2017, issued by the FMCSA Regional Field Administrator for the Southern Service Center, including any future amendments or extensions or limitations. This Notice will expire upon the expiration or termination of Regional Emergency Declaration No. 2018-000 1, including any future extensions.

STATE OF ALABAMA
PROCLAMATION BY THE GOVERNOR

 

WHEREAS the State of Alabama is under imminent threat of Tropical Storm Nate, which is expected to strengthen into a hurricane with the potential to make landfall in Mobile and Baldwin Counties;

WHEREAS this storm system is expected to bring increased rain activity and storm surge, with the threat of flooding and isolated tornadoes, the risk of which is expected to dramatically increase over the next 72 hours;
