EXTENSION OF REGIONAL EMERGENCY DECLARATION UNDER 49 CFR 390.25 FLORIDA, COMMONWEALTH OF PUERTO RICO AND THE TERRITORY OF THE U.S. VIRGIN ISLANDS

The Regional Field Administrators for FMCSA's Southern and Eastern Service Centers hereby declare that an emergency exists that warrants extension of the Regional Declaration of Emergency issued on September 6, 2017 as amended, and continuing the exemption granted in accordance with 49 CFR 390.23(a)(1) from Parts 390 through 399 of the Federal Motor Carrier Safety Regulations (FMCSRs) for Affected States and jurisdictions, except as otherwise restricted herein. Affected States and jurisdictions included in this extension of the Emergency Declaration are: Florida, the Commonwealth of Puerto Rico and the Territory of the U.S. Virgin Islands.

EMERGENCY WAIVER ORDER

In accordance with the provisions of 49 U.S.C. § 5103(c), the Acting Administrator for the Pipeline and Hazardous Materials Safety Administration (PHMSA), hereby declares that an emergency exists that warrants issuance of a Waiver of the Hazardous Materials Regulations (HMR, 49 C.F .R. Parts 171-180) to persons conducting operations under the direction of the Puerto Rico Public Service Commission within the Hurricane Maria emergency and disaster areas of Puerto Rico. The Waiver is granted to support the government of Puerto Rico in facilitating the transport of essential fuel.

EXECUTIVE ORDER OF THE GOVERNOR OF PUERTO RICO, HON. RICARDO ROSSELLÓ-NEVARES, DECLARING A STATE OF EMERGENCY DUE TO IMPENDING HURRICANE MARIA, AS WELL AS DEPLOYING THE NATIONAL GUARD TO PROVIDE SUPPORT DURING THIS EMERGENCY

WHEREAS: This Government shall take all necessary measures to safeguard public order and protect the life, security, and property of citizens and of the Government of Puerto Rico.

WHEREAS: On September 17, 2017, the National Weather Service stated that there is a high possibility that Puerto Rico will face strong winds and heavy rain, with the potential to cause severe flooding at some point during the next 48 hours, in the face of Hurricane María.
