Federal regulations (49 CFR 390.23) allow the temporary lifting of certain safety regulations for any motor carrier or driver providing direct assistance in relief during a declared emergency. This includes easing the HOS regulations for drivers. However, regulations do not allow FMCSA to suspend requirements for CDL, drug and alcohol testing or motor carrier financial responsibility (insurance).
Truck size and weight relief is a State-by-State matter, where the Federal Highway Administration (FHWA) is the lead Federal agency. Some States have size and weight or procedural relief in place for the emergency. Motor carriers desiring oversize/overweight permits should work with the States along their route. FHWA has more size and weight information available at www.fhwa.dot.gov.
Vehicle registration and fuel tax compliance are administered by the States through the International Registration Plan (IRP) and International Fuel Tax Agreement (IFTA), respectively. Again, motor carriers should work with the States along their route to see whether trip permits or emergency relief are available for registration and fuel tax.
